From the 2008 California DMV's Motorcycle Handbook, page 4, License Requirements-

Quote:
NOTE: Class C licensees may operate a motorcycle with a side car attached or a three-wheel motorcycle.
What's the specific vehicle code section cited on the ticket?

Re: Can-Am Spyder-Roadster

you are absolutely correct on that pete ! I told the officer that the can am spyder is not a motorcycle and is registerd as R/S road street category . I just need to bring the 2008 motorcycle handbook so i can show the judge that class c license may operate a motorcycle with a sidecar or a three wheeled vehicle... Thanks for the reply pete !

ps. still looking for a used honda vtx 1300 r

Re: Can-Am Spyder-Roadster

Love research. I could bring a copy of the handbook along and attempt to explain to base security the difference between the Spyder and M1. If they overrule, I'm still safe with the M1 rating.

A motorcycle:
• Has a seat for the rider and is designed to travel on two or not more than three wheels.(2)

California issues the following license classes for two-wheel vehicle operation:
• Class M1—You may operate any two-wheel motorcycle, motor-driven cycle, or motorized scooter and all vehicles listed under Class M2.(4)
• Class M2—You may operate any motorized bicycle, any bicycle with an attached motor, or a motorized scooter.(4)
NOTE: Class C licensees may operate a motorcycle with a side car attached or a three-wheel motorcycle.(4)
NOTE:The permit and license requirements in this handbook pertain to two-wheel vehicles and are referenced in Section 12804.9 of the Vehicle Code.(4)

California Motorcycle Handbook. DMV. 2008.

Remember, my fellow government minion, the DOD rules are based on federal DOT requirements for motorcycles (that and any other requirement they, or any of the separate armed forces, add on in the name of safety IE: the USAF allowing ONLY FF helmets), which may vary from one or more state requirements. I do believe there are states that do require a motorcycle license/endorsement/whatever to ride a trike/spyder.

I suspect the response would be along the lines of "Rules, shmooles - Uncle Sam owns your a$$, son. We are the rules"

If someone at the DMV is telling you that you must have an M1 to ride the Spyder (and they're wrong, btw), you should show up on the Spyder for your driving test. Then let them try to explain why you can't use the Spyder to take the test to get the license they they claim you need to ride the Spyder . Even better - have a friend video tape the conversation and post it up in the humor section -- I'd love to hear that explanation
